The Merit Systems Protection Board (MSPB) is the primary avenue for federal employees to submit whistleblower complaints – and it is currently in crisis. The MSPB has not had a quorum in over four years and has not had a single sitting member since early 2019. Given this historic absence of members, there is an ever-growing backlog of whistleblower retaliation cases. As of January 2021, the backlog was over 3,100 cases.
In light of this situation, it is critical that Congress take immediate action to preserve and strengthen the MSPB in order to protect federal employees from retaliation, favoritism, and other arbitrary actions.
The Merit Systems Protection Board Empowerment Act, introduced on a bipartisan basis in the House of Representatives in February 2021, is an important first step towards remedying this crisis. This bill will reauthorize the MSPB through 2026 and require successful completion of whistleblower training for MSPB members, administrative judges, and other applicable employees – a long needed reform.
Federal employee whistleblowers have had cases sitting for years without resolution. That’s why it is so important to see these improvements enacted – and quickly. So, please, take action today: urge your representatives to pass this bill.
