The Merit Systems Protection Board (MSPB) is in crisis. The MSPB has not had a quorum in over four years and has not had a single sitting member since early 2019. Given this historic absence of members, there is an ever-growing backlog of whistleblower retaliation cases. As of January 2021, the backlog was over 3,100 cases.
Unlike other federal agencies, the MSPB cannot be temporarily filled with “acting” members. Instead, the two-member quorum is limited to individuals appointed by the President and confirmed by the Senate.
It is now up to the Biden administration to do the right thing and appoint qualified nominees. Federal employee whistleblowers have had cases sitting for years without resolution.
It's critical to see appointments to the MSPB – and quickly. So please, take action: urge President Biden to nominate two members to the MSPB today.
