In the wake of the 2008 financial crisis, the Dodd-Frank Act was enacted to prevent another economic collapse. One of the key aims was incentivizing and protecting whistleblowers. However, these whistleblower provisions have been under attack ever since.
In 2018, the Supreme Court passed down a disastrous ruling in Digital Realty Trust v. Somers that greatly limited who qualified as a whistleblower and thus was entitled to protections under law. Since its inception, we’ve been working tirelessly to combat these changes.
Now, we've made critical progress. In 2019, Senator Chuck Grassley introduced a new bill, the Whistleblower Programs Improvement Act (WPIA), that will clarify the scope of protection for securities and commodities whistleblowers, effectively overturning Digital Realty. It will also combat the long delays in processing Dodd-Frank rewards.
