Reform the IRS Whistleblower Program

Since the passage of the Tax Relief and Health Care Act in 2006, the IRS Whistleblower Program has become a highly effective tool in targeting tax cheats. In the last 13 years, the IRS Whistleblower Office has collected over $5.7 billion in unpaid tax revenue.

But despite their critical contributions, IRS whistleblowers do not receive the same rights and protections as other whistleblowers.

With Congress authorizing unprecedented funds, including tax benefits, to address the Covid-19 crisis in recent months, it is time to prioritize stopping tax fraud. The best way to do so is to strengthen the IRS Whistleblower Program through a series of new reforms.

These reforms should include:

Ensuring IRS whistleblowers receive a real right to judicial review – a critical aspect of any successful whistleblower program;
Ensuring prompt payment of awards;
Ending sequestration of awards;
Clarifying reading of “proceeds based on”;
Using whistleblower proceeds to fund the Whistleblower Office; and
Highlighting top tax violations in annual whistleblower report.

Reform the IRS Whistleblower Program

Despite their critical contributions, IRS whistleblowers do not receive the same rights and protections as other whistleblowers. With Congress authorizing unprecedented funds, including tax benefits, to address the Covid-19 crisis in recent months, it is time to prioritize stopping tax fraud. Urge Congress to reform the IRS Whistleblower Program today.

Dear Senator, I am writing to urge you to reform and strengthen the IRS Whistleblower Tax Program. Since the passage of the Tax Relief and Health Care Act in 2006, the IRS Whistleblower Program has become a considerable success and proven to be a highly effective tool in targeting tax cheats. In the last 13 years, the IRS Whistleblower Office has collected over $5.7 billion in unpaid tax revenue thanks to whistleblowers. In a recent review by the Treasury Inspector General for Tax Administration (TIGTA), they discovered that audits and exams based on whistleblower information are nearly twice as productive as normal IRS examination and allows the IRS to focus its limited resources on the bad actors. However, the current whistleblower tax law fails to implement critical aspects provided in most modern whistleblower programs. This includes a lack of judicial review and anonymity in Tax Court, which can be detrimental to whistleblowers with actionable information. In order to make the IRS Whistleblower Program even more successful and provide whistleblowers with the confidence they need to step forward, I recommend the following reforms put forth by the National Whistleblower Center: 1.	Guaranteeing de novo review of whistleblower awards in Tax Court; 2.	Ensuring prompt payment of awards; 3.	Ending sequestration of awards; 4.	Clarifying reading of “proceeds based on”; 5.	Clarifying Tax Court discovery for whistleblowers and improve protection of taxpayer information; 6.	Presuming anonymity in Tax Court; 7.	Using whistleblower proceeds to fund Whistleblower Office and reimburse expenses; and 8.	Including top tax violations in annual whistleblower report. Given the unprecedented amount of federal funds being provided through tax expenditures in response to Covid-19, strengthening and improving the tax whistleblower program - the best anti-fraud program at the IRS - is a critical part of preserving the integrity of our tax system and protecting the public. I ask that you take these reforms into consideration and act to further protect whistleblowers. Thank you for your time.
