The False Claims Act (FCA) is the government’s most powerful tool to prevent waste, fraud, and abuse, bringing in more than $60 billion to government coffers since 1986. Whistleblowers have been key to this success through its qui tam provision.
However, now the Act is under threat. In a recent brief, the Solicitor General argued that the Department of Justice (DOJ), which handles FCA cases, has discretion to dismiss any qui tam claims without a hearing for the whistleblower.
This is directly against the intent of Congress and could have disastrous consequences.
We are currently in the midst of an unprecedented crisis with the rapid spread of coronavirus and its economic impacts. As massive amounts of government spending enter the economy, there are now more opportunities for waste, fraud, and abuse than ever.
We need whistleblowers to hold the powerful to account at this critical moment, and the False Claims Act has proven to be one of the best ways to do so. The DOJ must not go beyond the law and dismiss qui tam cases without review. This will only discourage other whistleblowers from coming forward and hinder extremely successful legislation.
So please, write to your representatives and Attorney General William Barr today. Demand that the Department of Justice recognize the importance of whistleblowers and protect the False Claims Act. It’s what Congress intended.
